Divorce proceedings for Salvadorans living in the United States

Are you Salvadoran and thinking about getting a divorce from the United States?

Until a few years ago, legal divorce in El Salvador was impossible to process from abroad, but now it is possible to do so effectively, quickly, and safely.

According to the 2017 census in the United States, it was shown that 24.46% of the Salvadoran population currently lives in that country, making it the second largest Hispanic population after Mexico. Due to this population movement, the divorce rate has also increased in recent years.

Do I want to get divorced in the United States?

Divorce is the process of dissolving or separating a marriage by decree, with the definitive separation of marital cohabitation.

Before obtaining a divorce abroad, you must consider article 117 of the Family Code : "Divorce decreed abroad, between those who have married in accordance with Salvadoran law, will only be effective in El Salvador when the cause invoked is the same or similar to those recognized in this Code."

  • Mutual consent
  • Absolute separation (for separation of more than one year)
  • Intolerable common life (intolerability of characters).

To carry out this procedure from the United States, it must be taken into account that if the civil marriage took place in El Salvador, it must be dissolved within Salvadoran territory for it to be legal. Otherwise, if a divorce decree is not issued, the spouse who remarries may be accused of bigamy, leading to a lawsuit.

Possible Cases of Divorce for Salvadorans

We can find three types of marriages to dissolve:

  • Two Salvadorans married in El Salvador who want to divorce in the United States.
  • A Salvadoran man and a foreigner married in El Salvador and want to get divorced in the United States.
  • You are Salvadoran, you live in the United States and your spouse (husband or wife) lives in El Salvador

In all three cases, the marriage is entered into the Salvadoran Family Registry, and if a divorce occurs, this event will be added to the registry. Therefore, filing a divorce from the United States without professional assistance is not legally valid.
